Official "Showcase Your Custom Bike" Contest Rules and Regulations

GENERAL: The LoJack contest "Showcase Your Custom Bike" (this "Contest") is a contest where eligible entrants will have the chance to win a fully installed LoJack for Motorcycles unit. Eligible entrants must enter this Contest through www.motorcycles.com

ELIGIBILITY:  This Contest is only open to entrants whose home address, as of the date of the entry, is in the Sponsor’s coverage area.  Entrants must be at least 18 years old.  Entrants must go to http://my.lojack.com/pages/owners-accessories-coverage.aspx to view LoJack’s coverage area.  Further, the entrant must be willing to travel to the closest approved motorcycle dealer or the prize will be forfeited.  Please go to http://www.lojack.com/pages/dealer-results.aspx to find the dealer closest to you. This Contest is void outside the fifty (50) United States and the District of Columbia; and where prohibited or restricted by law.  Employees, officers, and directors of the Sponsor and its respective subsidiaries, affiliates and divisions, and the immediate families of such employee, officer and director, are not eligible to enter. 

TIMING:  Three different Contests will be held during 2008.  The Entry Period for each contest are defined below.  

·          The first Contest begins at 12:01 AM Eastern Time on Sunday, April 6, 2008 and ends at 11:59 PM Eastern Time on Monday, June 30, 2008 (the "Entry Period").  The category of this contest is SPORT BIKE.   

·          The second Contest begins at 12:01 AM Eastern Time on Tuesday, July 1, 2008 and ends at 11:59 PM Eastern Time on Tuesday, September 30th (the "Entry Period"). The category of this contest is CRUISER.

·          The third Contest begins at 12:01 AM Eastern Time on Wednesday, October 1, 2008 and ends at 11:59 PM Eastern Time on Wednesday, December 31, 2008 (the "Entry Period").  The category of this contest is SPORT TOURING.

HOW TO ENTER: Go to www.motorcycles.com to enter.  Select either "ENTER" or "VOTE".  Completely fill out the online registration/entry form and submit it in accordance with the on-screen instructions.  All entries must be received by the Sponsor during the Entry Period.   Only one entry per person, per Entry Period, will be accepted.  In the event of a dispute about the identity of an entrant, each entry will be identified by the owner of the e-mail address provided.  Proof of online submission will not be proof of receipt of entry by the Sponsor. Entrants will automatically be registered to receive promotional information from the Sponsor.

DETERMINING THE WINNER: During the first business day after an Entry Period expires, a representative from Motorcycles.com shall tally all the votes for all the eligible entrants.  The entry with the most number of votes will be identified as the winner.  In the event of a tie, the individual who entered the contest first, based upon the Motorcycle.com recorded date and time stamp of their entry, shall be appointed the winner of a LoJack for Motorcycles unit.

NOTIFICATION:  The winner of each contest shall be notified by a representative from MOTORCYCLES.COM within two weeks of the last date of the Entry Period.  The winner will be notified by phone, email and/or letter sent via US Mail.  A representative from LoJack will follow up with the winner to arrange for the installation. The winner shall be required to execute a FORM W2 (for tax purposes) and a Liability Release in order to claim the prize.  If the winner cannot be personally contacted within seven (7) days of the first attempt to contact them, or he/she fails to provide the above mentioned required documents, the winner will be disqualified and an alternate winner will be determined by a representative of Motorcycles.com from the remaining pool of qualified and eligible entrants. 

TAXES:  All federal, state and local taxes, if any, are the sole responsibility of the winner.  The winner shall receive an IRS Form 1099 reflecting the value of the prize if said value is greater than $600.00.

PUBLICITY:  Except where prohibited by law, participation in this Contest constitutes winner’s consent to Sponsor’s use of winner’s name, biography, likeliness, photographs for promotional purposes in any manner or media without further notice, consideration, or consent.

ODDS:  The odds of winning the prize are dependent on the number of qualified entries received by the Sponsor during any of the Entry Periods.

GENERAL RULES OF PARTICIPATION: By participation in this contest, participant agrees to these rules and the decisions of the Sponsors, which are final and legally binding in all matters relating to this promotion.  Released Parties and their promotional partners, their parents, subsidiaries, affiliates, and advertising or promotion agencies and each of their respective agents, employees, directors, representatives and officers of any of the above shall have no liability whatsoever and shall be held harmless for any injuries, losses or damages of any kind to persons, including death and property damages sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession or use/misuse of any prize, or participation in this promotion. As a condition of entering contest, participant agrees that (1) under no circumstances will participant be permitted to obtain award for, and participant hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses, (2) all causes of action arising out of or connected with this contest, or any prizes/discounts awarded, shall be resolved individually, without resort to any form of class action and shall be resolved exclusively by arbitration under rules of the American Arbitration Association; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket cost incurred, including costs associated with entering this contest, but in no event attorney's fees.
